RECO / TRESA · Business & conduct
The articles expressly permit the corporation to hold itself out as trading in real estate
What the rule requires
The corporation must not represent, advertise or promote itself as carrying on the business of trading in real estate or as being a brokerage.
Authority: O. Reg. 536/20, s. 3 ¶3 (public representation)
What goes wrong
The articles do not bar holding out. They expressly permit the corporation to represent itself to the public as trading in real estate or as a brokerage, which is the conduct O. Reg. 536/20, s. 3 para 3 forbids outright. A corporation relying on the exemption is not registered under TRESA, so the representation is of something it is not entitled to be.
What good looks like
The articles contain a provision to this effect.
